There was a motion to accept the minutes of the August 19th Special Meeting.  The motion was seconded and accepted with a vote of 6-0-1; 6 Yes, 0 No, 1 Abstention.

Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.  


Public Hearing – Notice of Intent - 7 Old Forge Hill Rd. – Unionville Commercial - CE159-988
Mr. Rick Goodreau, Engineer of United Consultants, and Mr. Paul Compton, the owner of the property, both appeared before the Commission for the construction of a commercial building on the site of a demolished building.

Mr. Goodreau informed the Commission that there was previously a building on the site that has been demolished and the applicant would like to construct a new building on the existing footprint.  

The site is located in close proximity to Mine Brook.  The plans depict the building being constructed on the south side, which is farthest from Mine Brook.  There is a stormwater system with 2 swales to capture the water in two locations on the site and discharges into a bioretention area.  The roof runoff will be captured and piped along the north side of the building and discharge into the bioretention area as well.

Mr. Alfieri informed the applicant of 3 items to be addressed in this Notice of Intent filing.  He also informed the Commission that the Town Engineer has submitted a letter dated September 14th with his concerns regarding the drainage for the site and this letter has been read into the record and added to the Conservation file.  Mr. Bill Yadisernia, who was present at the hearing, explained to the Commission the details of this letter.

Mr. Goodreau stated that he would like to discuss Comment #1 in Mr. Yadisernia’s letter in more detail with the Commission.  

A Commission member requested that the Latin names for the plantings be added to the plan.

The Commission Chairman opened the 8:00 p.m. continued public hearing for 18 Concetta Way.  There was a motion to continue the hearing for 18 Concetta Way until the conclusion of this hearing.  The motion was seconded and accepted with a vote of 7-0-0.

A Commission member agreed with Mr. Yadisernia that the purpose of the bioretention cell is that they are built to collect sediment and filter dirty water from the parking lot.

Another Commission member questioned Mr. Goodreau as to the nature of the soils on the site; i.e., the permeability.  Mr. Goodreau stated that it is not very good.  The roof runoff will not be infiltrated because the soils are not conducive to this.

Another Commission member questioned Mr. Goodreau as to what type of roof will be constructed on this building.  Mr. Goodreau stated that a metal roof will be used.  A Commissioner stated that it is his understanding that there is no discharging allowed from a metal roof into the ground.  Mr. Goodreau stated that with certain types, it is allowed and he will obtain this information as well as an explanation for the Commission’s review.

There was a discussion regarding whether or not Mr. Yadisernia’s recommendations regarding how the drainage will be handled will be accepted by the Commission and this will be looked at at the upcoming site walk.  

The matter of whether recharge of a metal roof would comply with the regulations with also be taken up at the upcoming site walk.

There was no one present in the audience for this public hearing.

There was a motion to continue the public hearing until October 1st so that the Commission may conduct a site walk.  The motion was seconded and accepted with a vote of 7-0-0.  The Commission will conduct a site walk on Tuesday, September 29th at 6:30 p.m.


Continued - Public Hearing – Notice of Intent - 18 Concetta Way – Cropanese - CE159-985
Ms. Cheryl Petersen, Engineer of Heritage Design Group, appeared before the Commission for the construction of an in-ground swimming pool.  Ms. Petersen submitted an updated Notice of Intent and revised plans for the Commission’s review and informed the members that she has incorporated all of Mr. Alfieri’s comments into this revised package.  Ms. Petersen stated that she has added the fountain to the plans, which is currently in the pond on the site, so that it would be a permanent structure.  The mitigation plan has been put together to provide more protection to the resource area.  The pool is depicted on the plan to have a closed cartridge filtering system as well as a non-halogenated sanitation system.  There are erosion controls placed at the edge of disturbance.  

Ms. Petersen stated that at the recommendation of Natural Heritage, two froglogs have been specified to be located in the pool.  Also, Natural Heritage recommended that an elevation change be made to the pool deck and the adjacent ground to protect the salamanders on the site.  The pool layout has been changed to reduce the amount of impact within the 25-50 ft. buffer zone.  A dewatering plan has also been added to the plan.  The functions and characteristics plan has been added as well.

Mr. Alfieri informed the Commission that all of his comments have been addressed by Ms. Petersen and commended her on the quality of the functions and characteristics statement.

A Commission member questioned the fence being replaced with flashing to prevent the salamanders from digging under the fence and gaining access to the pool.  The placement of the froglogs in the pool would give the frogs the ability to exit from the pool if it was necessary.  A froglog is a device which enables small wildlife, such as salamanders and frogs, to easily exit the pool.

A Commission member informed Ms. Petersen that the revised plans are a much better fit for the site.

Some special conditions which were discussed with Ms. Petersen were the standard pool conditions and a perpetual condition stating that the fountain in the pond remain in that location in perpetuity.

There was no one present in the audience for this public hearing.

There was a motion to close the public hearing for 18 Concetta Way.  The motion was seconded and accepted with a vote of 7-0-0.

GENERAL BUSINESS

Discussion:  Initial Discussion on Request for Determination
There was a preliminary discussion among the Commission members regarding the Request for Determination of Applicability under the Local Bylaw.  The Vice Chairman stated that he felt it is an extremely time consuming and expensive process with abutter notification as a part of this process.  He asked for Commissioner’s comments regarding this requirement and a discussion ensued on this matter and the Commission asked for Mr. Alfieri’s input on this matter as well.

There was a motion to request that Mr. Alfieri prepare a revision to the Bylaw to eliminate abutter notifications and the requirement that the applicant post a public notice in the newspaper for Request for Determination filings.  The motion was seconded and accepted with a vote of 6-1-0; 6 Yes, 1 No, 0 Abstentions.
Minor Buffer Zone Activity:  31 James Street
The applicant has requested to remove the roof on the garage and frame a new addition to the second floor.  All of the work will be outside of the buffer zone.  It is, however, in close proximity to the wetlands.

A Commission member stated that he would like to have the compost area be located outside of Conservation jurisdiction.

There was a motion to issue a Negative Determination subject to the 3 standard conditions and a condition designating a spot for lawn clippings adjacent to the tree line satisfactory to the Agent and any stockpiled material must be placed outside of Conservation jurisdiction.  The motion was seconded and accepted with a vote of 6-1-0; 6 Yes, 1 No, 0 Abstention.

Minor Buffer Zone Activity:  8 Longobardi Drive
The applicant has requested to remove the stairs and construction of a 6’x8’ deck on sono tubes.  The work will take place 60 ft. away from the wetlands.

A Commission member stated that the steps should be depicted on the plan.  It was also noted that pressure treated lumber should be used on the deck but not for the support structures.

There was a motion to issue a Negative Determination subject to the 3 standard conditions as well as conditions designating a location for the compost area outside of Conservation jurisdiction, no pressure treated wood should be used for the deck with the exception of the support structures, and stairs, if applicable, should not face toward the south and the stockpiling should be done outside the easement.  The motion was seconded and accepted with a vote of 7-0-0.

Certificate of Compliance:  1 Kenwood Circle – SE159-544
Mr. Alfieri informed the Commission members that this is a multi-use building.  There is a dumpster located on the site which has been moved out of Conservation jurisdiction.

There was a motion to issue a Certificate of Compliance for 1 Kenwood Circle.  The motion was seconded and accepted with a vote of 6-1-0; 6 Yes, 1 No, 0 Abstentions.
